PROPERTY PRESENTATION
CASA HUGO is a private upscale short-term rental establishment offering furnished suites intended for temporary stays, exclusively for use as a temporary and short-term residence.
CASA HUGO may also provide, on an ancillary basis, certain additional services designed to enhance the Guest experience.
These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) govern all reservations made directly with CASA HUGO, including reservations made through the property’s official website.
CASA HUGO is not intended to constitute the Guest’s primary or secondary residence within the meaning of the legal provisions applicable to residential tenancy agreements.

Accessibility
Due to the layout of the premises and the existing facilities, the establishment is not suitable for guests with reduced mobility (PRM). Certain areas of the property may include steps, staircases, or other obstacles that may restrict movement. Guests are encouraged to verify, prior to making a reservation, that the accommodation’s features are compatible with their mobility needs and requirements.

PURPOSE OF THE TERMS AND CONDITIONS
These Terms and Conditions define the booking, payment, occupancy and stay conditions applicable to the suites offered by CASA HUGO.
Any reservation implies full, unconditional and irrevocable acceptance of these Terms and Conditions as well as of the Property Rules.
The applicable Terms and Conditions are those in force on the date the reservation is confirmed.
CASA HUGO reserves the right to amend these Terms and Conditions at any time. Any amendment shall not apply to reservations already confirmed.

RESERVATIONS AND OCCUPANCY CAPACITY
All reservations are strictly personal and may not be assigned, transferred or sublet without the prior written consent of CASA HUGO.
The Guest undertakes to provide accurate, complete and up-to-date information when making a reservation.
A reservation shall only be deemed final upon:
validation of payment;
express acceptance of these Terms and Conditions;
confirmation issued by CASA HUGO.
Each suite has a maximum occupancy capacity which may not be exceeded at any time during the stay.
Each suite is strictly limited to a maximum of two (2) occupants, including children, unless expressly agreed otherwise in advance by CASA HUGO.
The minimum stay requirement is two (2) consecutive nights.
Reservation requests can be subject to manual review and approval by CASA HUGO. Final confirmation is generally issued within twenty-four (24) hours following the reservation request and verification of the information provided.
Any undeclared additional guest may result in:
refusal of access to the property;
immediate cancellation of the stay without refund;
and/or additional charges.
CASA HUGO reserves the right to refuse or cancel any reservation in the event of:
non-compliance with these Terms and Conditions;
inappropriate behaviour;
manifestly inaccurate or misleading information;
or any risk to the safety of the property, its assets, guests or occupants.

RATES AND PAYMENT
All rates are displayed in euros and include the services specified at the time of booking.
Article 261 D, 4° of the French General Tax Code (Code général des impôts), provided that the legal conditions required for such exemption continue to be met.
Where certain additional services are provided by independent third-party providers, the pricing and tax conditions applicable to such services shall be determined exclusively by the relevant providers.
Unless otherwise stated, all applicable taxes are included in the displayed prices.
Reservations must be paid using the payment methods offered on the CASA HUGO website.
CASA HUGO reserves the right to require:
full payment at the time of booking;
and/or a prior bank guarantee or card pre-authorisation.
Any reservation not paid within the specified time limits may be automatically cancelled.
The Guest warrants that they are authorised to use the payment method provided.
In the event of a payment refusal, suspected fraud or payment incident, CASA HUGO may suspend or cancel the reservation without compensation.

CANCELLATION POLICY
Unless otherwise stated at the time of booking, the following cancellation policy shall apply:
any cancellation made more than fourteen (14) days prior to the scheduled arrival date shall entitle the Guest to a refund of amounts paid, less any irreversible banking charges or reasonable administrative costs incurred;
any cancellation made less than fourteen (14) days prior to the scheduled arrival date shall not be eligible for any refund;
in the event of a no-show, early departure or voluntary interruption of the stay by the Guest, no refund shall be due.
Any exceptional request shall remain subject to the sole discretion of CASA HUGO.
Should CASA HUGO be exceptionally unable to perform its obligations, its liability shall be limited to direct, foreseeable and duly substantiated losses resulting from such non-performance, in accordance with the applicable provisions of French civil law.

SECURITY DEPOSIT AND CARD PRE-AUTHORISATION
CASA HUGO may require, prior to the Guest’s arrival, the provision of a security deposit intended to cover:
material damage;
repair and restoration costs;
deterioration or damage to the accommodation;
exceptional cleaning costs;
missing items;
or any breach of these Terms and Conditions or the House Rules.
Unless otherwise specified, the standard amount of the security deposit is set at four hundred euros (€400).
The security deposit is managed through the specialised provider Swikly, in accordance with the procedures communicated to the Guest prior to arrival.
The Guest undertakes to complete all formalities required for the provision of the security deposit within the timeframe specified by CASA HUGO. Failing this, CASA HUGO may refuse access to the accommodation without entitlement to any refund where the applicable booking conditions do not permit one.
Provided that no damage, incident or justified deduction is identified, the security deposit shall be released in accordance with the procedures and timeframes applicable to Swikly.
The Guest expressly authorises CASA HUGO to request any justified deduction corresponding to damage, loss or prejudice actually incurred.
Any deduction may be supported, in particular, by:
photographs;
inspection reports;
quotations;
invoices;
intervention reports;
or any other relevant supporting evidence.
CASA HUGO reserves the right to initiate any additional legal or recovery proceedings in the event that the loss or damage suffered exceeds the amount of the security deposit.

CHECK-IN / CHECK-OUT
Check-in is available from 4:00 p.m. and no later than 10:00 p.m. on the scheduled arrival date.
Check-out must take place no later than 11:00 a.m. on the scheduled departure date.
CASA HUGO does not operate a permanent reception desk. Guests therefore undertake to communicate, as far in advance as reasonably possible, an estimated arrival time together with any significant change thereto.
Compliance with this requirement is necessary to organise guest reception and access handover. In the absence of prior notice or in the event of a significant unreported delay, CASA HUGO shall not be held responsible for any waiting time upon arrival.
Any arrival after 10:00 p.m. is subject to the prior express approval of CASA HUGO and cannot be guaranteed.
Any request for early check-in, late check-out or stay extension remains subject to the prior express approval of CASA HUGO and cannot be guaranteed.
The Guest must return the suite in a reasonable condition and vacate the premises at the agreed time.
additional charges;
reinstatement or cleaning fees;
or the charge of an additional night where reletting of the suite is compromised.
CASA HUGO reserves the right to refuse access to any person:
whose identity cannot be verified;
whose behaviour appears incompatible with the safety, tranquillity or standards of the property;
or who fails to comply with these Terms and Conditions.
In accordance with applicable regulations, foreign guests may be required to complete a police registration form.

OCCUPANCY CONDITIONS AND PROPERTY RULES
The Guest undertakes to use the premises peacefully, in accordance with their intended purpose and with due respect for:
these Terms and Conditions;
the Property Rules;
other guests and occupants;
neighbouring residents;
and all property, furnishings and equipment made available.
All suites, facilities, artworks, decorative objects, furnishings and installations within CASA HUGO must be used with due care and attention.
The following are strictly prohibited:
exceeding the maximum authorised occupancy;
admitting undeclared guests;
organising unauthorised parties or events;
causing excessive noise or disturbances;
smoking inside the suites;
moving, handling or removing artworks, decorative objects or equipment without prior authorisation;
introducing illegal substances onto the premises;
using the property for professional, commercial, promotional, event-related or unlawful purposes without prior written approval;
disturbing the tranquillity of the property or neighbouring residents.
The Guest shall remain responsible for:
their own actions;
the actions of accompanying persons;
and any visitor admitted to the property.
Any serious or repeated breach may result in:
immediate termination of the stay;
removal from the property;
without refund or compensation.
Pets are only permitted subject to the prior express approval of CASA HUGO.
The Guest undertakes to report without delay any incident, damage or malfunction identified during the stay.
Additional Services and Curated Stays
To enhance the guest experience, CASA HUGO may offer certain additional services that are optional and separate from the accommodation services.
Services provided directly by CASA HUGO may include:
access to the self-service laundry facilities, charged according to the rates displayed on-site;
ironing services;
concierge services;
private shopping services;
and any other service expressly identified as being provided by CASA HUGO.
Unless otherwise specified, these services are not included in the accommodation rate and are charged separately.
CASA HUGO may also offer guests a selection of activities, experiences or services delivered by independent professionals, including but not limited to wellness services, leisure activities, local experiences, transportation services and other complementary services.
In such circumstances, CASA HUGO acts solely as an intermediary and facilitator in the organisation or coordination of the guest experience.
The contract relating to the relevant service is concluded directly between the Guest and the independent provider.
The provider remains solely responsible for the performance of its services, including compliance, quality, safety and adherence to all applicable legal and regulatory requirements.
CASA HUGO shall not be liable for any loss, damage, cancellation, modification, total or partial non-performance, or improper performance relating to services provided by an independent third-party provider.
Any complaint relating to a service provided by an independent provider must be addressed directly to that provider.
The rates applicable to optional services and additional experiences shall be communicated to the Guest prior to confirmation or booking.
The Guest remains entirely free to accept or decline any additional service offered.

DAMAGE AND LIABILITY
The Guest shall be liable for any damage, deterioration, loss, disappearance or alteration occurring during the stay and attributable to:
the Guest;
occupants;
visitors;
or any person admitted to the property by the Guest.
The costs of repair, replacement, exceptional cleaning or reinstatement may be charged to the Guest upon presentation of appropriate supporting documentation.
CASA HUGO may in particular claim:
repair or replacement costs;
intervention costs;
reinstatement expenses;
loss of revenue directly resulting from the temporary unavailability of the suite or facilities;
reasonable administrative expenses incurred;
and any direct loss resulting from the damage identified.
Guests are encouraged to ensure that they hold adequate liability insurance covering any damage that may occur during their stay.
The suites and common areas may contain artworks, decorative objects, furnishings, equipment and design features of particular artistic, heritage or aesthetic value.
Any deterioration, damage, disappearance or alteration attributable to the Guest, accompanying persons or visitors may result in charges corresponding in particular to:
repair or restoration costs;
replacement costs;
the market value of the item concerned where repair or replacement is impossible;
expert appraisal fees where necessary;
and any direct loss suffered by CASA HUGO as a consequence.
Artworks, decorative objects, premium furnishings and design elements are subject to particular care and attention. Any damage, loss, deterioration or abnormal use may result in charges based upon:
specialist quotations;
repair or replacement invoices;
valuations prepared by a qualified professional;
or any other objectively justified assessment.
CASA HUGO shall not be liable for:
loss, theft or misplacement of personal belongings belonging to the Guest or accompanying persons;
temporary interruptions of technical services beyond its reasonable control;
disruptions caused by third parties;
consequences arising from improper use of facilities or equipment by the Guest;
events constituting force majeure under French law.
In connection with additional services offered to guests, CASA HUGO may:
provide certain services directly, including personalised concierge services and private shopping assistance;
or facilitate access to services delivered by carefully selected independent third-party providers.
Where a service is delivered by an independent third-party provider, including massages, activities, excursions, transportation services, restaurants, guides, drivers or other partners, the service agreement is concluded directly between the Guest and the relevant provider.
In such circumstances, each provider remains solely responsible for the performance of its services, their conformity, quality, cancellation, modification and compliance with applicable legal and contractual obligations.
CASA HUGO’s liability shall therefore be strictly limited to its role as facilitator, coordinator or intermediary where applicable.
Nothing in these Terms and Conditions shall exclude or limit CASA HUGO’s liability:
in cases of gross negligence;
in cases of wilful misconduct;
in respect of personal injury attributable to CASA HUGO;
or where such exclusion or limitation is prohibited by applicable law.

INTERNET ACCESS, SECURITY AND VIDEO SURVEILLANCE
Wi-Fi internet access may be made available to guests as an ancillary service.
CASA HUGO does not guarantee:
uninterrupted access;
continuous availability;
or any specific level of network performance.
Guests undertake to use internet services in compliance with applicable laws and regulations and shall refrain from:
any unlawful activity;
any prohibited downloading activity;
any attempt to gain unauthorised access to computer systems;
or any use likely to compromise network security.
For the safety and security of persons and property, certain common areas and external access points may be subject to video surveillance in accordance with applicable regulations.
Any processing of personal data carried out in this context is governed by the CASA HUGO Privacy Policy.

PERSONAL DATA
In the context of reservations and the operation of the property, CASA HUGO may collect and process certain personal data relating to Guests.
Such processing is carried out in accordance with applicable data protection laws and regulations, including Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation – GDPR).
The data collected may be used in particular for:
reservation management;
payment processing;
guest relations;
property security;
compliance with legal obligations;
and service improvement purposes.

FORCE MAJEURE
CASA HUGO shall not be held liable for any failure or delay in the performance of its obligations where such failure or delay results from an event of force majeure as recognised under French law and jurisprudence.
Events that may constitute force majeure include, without limitation:
natural disasters;
fires;
pandemics;
governmental or administrative decisions;
labour disputes;
network failures;
widespread utility outages;
or any event beyond the reasonable control of CASA HUGO.
In the event of force majeure, the obligations of the parties may be suspended for the duration of the relevant event.

MEDIATION AND APPLICABLE LAW
These Terms and Conditions shall be governed by and construed in accordance with French law.
In the event of any dispute relating to the interpretation, validity, performance or termination of these Terms and Conditions, the parties shall endeavour to seek an amicable resolution before commencing legal proceedings.
In accordance with the provisions of the French Consumer Code, consumer Guests may have recourse, free of charge, to a consumer mediator for the amicable resolution of a dispute.

Should no amicable resolution be reached, jurisdiction shall be determined in accordance with the mandatory rules applicable to consumers under French law.

ACCEPTANCE OF THE TERMS AND CONDITIONS
Any reservation made with CASA HUGO implies:
prior consultation of these Terms and Conditions;
full, unconditional and irrevocable acceptance thereof;
and acceptance of the Property Rules.
The Guest acknowledges that they:
have read these Terms and Conditions prior to confirming the reservation;
possess the legal capacity required to enter into a binding agreement;
and are acting for personal and non-professional purposes, unless otherwise expressly agreed.
Acceptance of these Terms and Conditions is evidenced in particular by:
electronic confirmation of the reservation;
payment of the reservation;
and the mandatory acceptance checkbox completed prior to final confirmation of the booking.
CASA HUGO retains transaction records, evidence of consent and associated technical records in accordance with applicable laws and regulations.
These Terms and Conditions constitute the entire agreement between CASA HUGO and the Guest in relation to the reservation concerned.
In the event of any discrepancy or inconsistency between the French and English versions of these Terms and Conditions, the French version shall prevail.
